SUNSHINE OIL (02012.HK): Alberta Regulator Upholds West Ells Abandonment Order; Firm Weighs Reconsideration and Judicial Review
NewTimeSpace News: On 20 October 2026, Sunshine Oilsands Ltd. (the "Company") published a supplemental announcement to its announcement dated 19 August 2026. The hearing panel of the Alberta Energy Regulator (the "Regulator") formally issued its decision on 18 August 2026 (Calgary time), upholding the Regulator's earlier decision requiring the Company to submit an abandonment plan for the West Ells oil sands project within 24 months. Although it acknowledged that the West Ells assets may have long-term resource value, the panel ruled that the original decision should stand, citing the past non-compliance record, on-site operational challenges, and its view that the Company's proposed financing arrangements and phased compliance plan were overly speculative and dependent on factors beyond its control.
The announcement disclosed that the board stressed the Company is assessing various legal and administrative remedies to protect its core oil sands operating assets. First, a reconsideration application: under Canadian law the Company has a statutory right to ask the Regulator to confirm, vary, suspend or rescind its own decision, and the Company is preparing a formal reconsideration application based on its latest financing arrangements, debt restructuring progress and operating plans (constituting a material change in circumstances) to seek variation or suspension. Second, judicial review: the statutory deadline to apply to the Court of King's Bench for judicial review is 18 February 2027 (within six months of the 18 August decision), and the Company is working with legal counsel to review administrative law grounds including procedural fairness and the reasonableness of the decision, reserving all rights to file formally within the statutory period. Third, an appeal to the Minister: the Company intends to submit formal written representations to the Minister of Energy seeking policy-level guidance and administrative intervention.
The Company stated that, to support these remedies and provide operating and funding support, it is pursuing parallel commercial options: first, a joint venture partnership, actively negotiating cooperation and development agreements with qualified operators recognised by the Regulator to maintain production and asset value and to place operating and environmental reclamation responsibilities with a compliant, well-funded entity, providing a statutory basis for the Regulator to vary, rescind or lift the decision; and second, asset disposal and restructuring, advancing targeted disposals of non-core assets to generate liquidity, meet regulatory requirements and support recovery of operational custody of the core project site. In addition, the Company is expanding beyond traditional oil sands to diversify revenue, reduce reliance on a single project and generate sustainable cash flow.
