NewTimeSpace News: Helens International Holdings (09869.HK) issued an announcement stating that the Beijing Higher People’s Court ruled the Chinese trademarks “海伦司”, “海伦司小酒馆” and “海伦司越大排档” invalid for being similar to third-party cited trademarks, upholding the original ruling issued by the China National Intellectual Property Administration (CNIPA). The Company is seeking legal advice and evaluating feasible remedies. Current assessment shows the trademark dispute exerts no material adverse impact on the Group’s overall business, daily operations or financial position. The Group may continue using the undisputed English trademark “Helen's” across daily operations.
NewTimeSpace News: Helens International Holdings Company Limited (09869.HK) released a voluntary announcement on 25 June 2026, disclosing the latest progress of legal proceedings concerning Chinese trademarks owned by its wholly-owned subsidiary Shenzhen Helens Brand Management Co., Ltd.
A third party previously filed applications for declaration of invalidation against trademarks including “海伦司”, “海伦司小酒馆” and “海伦司越大排档”, alleging such marks were confusingly similar to two registered cited trademarks held by the third party.
In May 2025, the CNIPA ruled that the disputed trademarks, in respect of bar services and similar categories, constituted similar marks and should be declared invalid.
Shenzhen Helens initiated litigation before the Beijing Intellectual Property Court, which delivered a favourable judgment in December 2025 to set aside the CNIPA’s invalidation ruling. The third party subsequently lodged an appeal with the Beijing Higher People’s Court.
On 23 June 2026, Shenzhen Helens received the judgment from the Beijing Higher People’s Court. The court held the disputed trademarks violated Article 30 of the Trademark Law of the People’s Republic of China, upheld the invalidation ruling, revoked the previous administrative judgment and dismissed all claims submitted by Shenzhen Helens.
The Company confirms it is obtaining professional legal advice and reviewing all viable remedial measures. Based on current evaluation, the above trademark dispute will not bring material adverse effects to the Group’s overall business, daily operations or financial status. The Group is entitled to continuously deploy the undisputed English trademark “Helen's” in daily business operations, which has been in use since 2009. Besides, trademark applications such as “Helen's bar” filed in 2013 carry an earlier application date than the third party’s cited trademarks.
